I work part time and my so receives ssid for himself and our son. He makes more than enough to cover our living expenses with money for himself. He has gotten himself (again) into a world of debt. He is at this time over a thousand dollars overdrawn on his checking account. Its been a on going problem with him. He just blows money foolishly on himself. My question is since he has been doing our taxes (I have never seen or signed any tax forms) on line and we split the return after he pays off his outstanding debt. I never had a problem with it until now. I was talking with my daughters fil about how I wish I could financially afford to get out of this circle of debt for my son and I. We have lost homes and cars ect because of his irrespondsibility. He seem to think that since he gets ssid that he has actually been taking my tax return because he doesn't have to file since none is taken out. He said I should file on my own claim hoh and take the tax return and start fresh for my son and I. I feel awful but as of right now we so behind on ultilities and he seem usfazed by this. Does anyone know if I can do this or because we are married I have to file with him.

Go to the IRS website, they have great information. But you certainly can file "Married filing Separately" you can't file HOH, but you can file on your own. Its pretty easy and you can get your check direct deposited into YOUR bank account. www.taxact.com is a great site. Its where I always do my taxes.

You don't have to file jointly. I would talk to a good accountant about it, though.

You can file separately but you cannot claim head of household status for your son if you are married to his father unless you have been living separately for 6 months out of the year. Also, some people who receive SSI disability payments do owe taxes on them. I think maybe you should do the taxes this year.

You can file seperately . Talk to an accountant or even the IRS will help you with your tax return. They do it for a small fee or even free it's according to your income. You may love this guy, but count your loses and get out. Your debt and your hole will keep continueing to get bigger. I have been in the same situation. It will be hard at first, but your life will fall into a better place once you rid of him and his destructive ways.
